Welcome to Ausallium By accessing or using our  “Website” (us.ausallium.com) and purchasing products from us, you agree to be bound by these Terms & Conditions (“Terms”). If you do not agree, please do not use our Website.

1. General

1.1 These Terms apply to all visitors, users, and customers of Ausallium.
 1.2 We reserve the right to update, modify, or replace these Terms at any time. The most current version will always be available on this Website. Your continued use constitutes acceptance of the updated Terms.

2. Products and Ordering

2.1 All seeds and products listed are subject to availability. We reserve the right to limit quantities, discontinue products, or refuse any order at our discretion.
2.2 We make every effort to display accurate product information, including pricing, descriptions, and images. However, we do not guarantee that all information is error-free.
2.3 Risk of loss and title for products passes to you upon delivery.

2.4 If Ausallium accepts an order which cannot be fulfilled, it will refund the Customer for the unavailable Products, and fulfil the rest of the order (if applicable).

3. Shipping & Delivery

3.1 We ship only to locations within the United States, unless otherwise stated.

3.2 It is the Customer’s responsibility to ensure that the delivery information they have provided to Ausallium is accurate. Ausallium will not be responsible for any losses suffered by the Customer (including lost orders) as a result of incorrect delivery information being provided.

3.3 Shipping times are estimates and not guaranteed. Delays may occur due to factors beyond our control.
3.4 You are responsible for ensuring that the purchase and possession of seeds comply with federal, state, and local laws in your area. Ausallium is not liable for illegal importation, cultivation, or distribution.

3.5 At no time does Ausallium take or accept any responsibility for the Delivery Location and all risk and liability in and relating to the Delivery Location remains with the Customer at all times.

4. Payment

4.1 Payments are processed via secure third-party providers. You agree to pay all charges associated with your order before goods are dispatched.

4.2 Payments for Products are not deemed to have been made unless and until the payment has cleared. Ausallium may reject an order if the payment cannot be processed or cleared.

 4.3 Prices are subject to change without notice. Taxes, shipping, and handling fees will be added where applicable.

5. Returns, Refunds & Cancellations

5.1 Due to the nature of seeds, we generally do not accept returns unless the product is defective or damaged during shipping.
5.2 If you receive a defective or damaged product, contact us within 7 days of delivery with proof (photos, order number). We may offer a replacement or refund at our discretion.
5.3 Cancellations may only be accepted before the order is processed or shipped.

6. Intellectual Property

6.1 All content on this Website, including text, images, logos, and designs, is owned by or licensed to Ausallium and protected by U.S. and international intellectual property laws.
6.2 You may not reproduce, modify, distribute, or use any content without our written permission.

8.4 Any purchases are made on the basis that the Customer acknowledges and agrees that significant variations in germination and growth of seed Products may occur due to differences in location, soil type, climate, season, moisture levels, growing medium and other environmental factors beyond Ausallium’s control. Seed products will not necessarily be suitable for a given location, soil type, climate or seasonal condition, and due to this variability Ausallium makes no representations or warranties regarding Product performance.

8.5 Ausallium recommends that the Customer obtain advice from a suitably qualified agronomist regarding the location, timing, and growing conditions under which the Products will be grown before the Customer orders any Products.

9. Limitation of Liability

9.1 To the maximum extent permitted by law, Ausallium and its affiliates are not liable for any direct, indirect, incidental, or consequential damages arising from the use of the Website or products, including loss of profits, personal injury, or property damage.
 9.2 You assume all responsibility for compliance with applicable laws regarding the purchase, possession, and cultivation of seeds.
